Terms of Use

Healthovia is developed and operated by Tech Avenue Labs ("we", "us"). These Terms of Use ("Terms") govern your use of the Healthovia mobile apps and this website (together, "Healthovia" or the "Service"). By downloading or using Healthovia you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Healthovia lets you measure heart rate, heart rate variability, stress and breathing rate with your phone camera, log blood pressure and other vitals, set reminders and create reports. Features may change over time.

2. Health and safety

• Healthovia is for general wellness and informational purposes only. It is not intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment or prevention of disease.
• Camera measurements can be affected by movement, pressure, light, skin temperature and your device. Camera blood-oxygen (SpO2) values are experimental estimates.
• Blood pressure is never measured by the camera. Values you log or import are only as accurate as the device they come from.
• Do not start, stop or change any treatment or medication based on Healthovia. Always consult a qualified healthcare professional.
• Reminders may be delayed or not delivered because of device settings, battery optimisation or other factors. Do not rely on Healthovia as your only reminder for critical medication.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use Healthovia. Profiles for children may be created and managed only by a parent or guardian.

4. Your data and account

Your readings are stored on your device as described in our Privacy Policy. An account is only needed for the optional cloud backup. You are responsible for keeping your device, your sign-in and your backup passphrase secure. Because backups are end-to-end encrypted, we cannot recover a backup if you forget your passphrase.

5. Premium, subscriptions and purchases

• Healthovia is free to download. Healthovia Premium is offered as an auto-renewing monthly or yearly subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy.
• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Subscriptions renew automatically at the same price and period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• If a free trial is offered, any unused part of the trial is forfeited when you buy a subscription. If you do not cancel before the trial ends, the subscription starts and you are charged.
• You can manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies.
• You can restore purchases on a new device from the Premium screen in the app.

6. Ads

The free version of Healthovia shows ads. Ads are never targeted using your health data. See our Privacy Policy for your choices.

7. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Healthovia on devices you own or control, for your own non-commercial use. You agree not to copy, modify, reverse-engineer or resell the Service; use it in a way that breaks the law; interfere with its security or operation; or use it to provide medical services to others.

8. Third-party services and devices

Healthovia can connect to Apple Health, Health Connect, Bluetooth devices and other third-party services. We are not responsible for third-party services or devices, their accuracy or their terms.

9. Intellectual property

Healthovia, its logo, design and content are owned by us or our licensors and protected by law. These Terms do not give you any rights to our trademarks.

10. Disclaimer of warranties

To the fullest extent permitted by law, Healthovia is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that any reading is accurate.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcomes or decisions made based on the Service. Our total liability for any claim is limited to the amount you paid for Healthovia in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

12. Termination

You can stop using Healthovia at any time and delete your data and account in the app. We may suspend or end access if you breach these Terms.

13. Changes

We may update these Terms. We will show the new "Last updated" date on this page and, for material changes, tell you in the app. Continuing to use Healthovia after changes means you accept them.

14. Governing law

These Terms are governed by the laws that apply where we are established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

15. Additional terms for the Apple App Store

If you downloaded Healthovia from the Apple App Store:

• These Terms are between you and us, not Apple. Apple is not responsible for Healthovia or its content.
• Apple has no obligation to provide maintenance or support for Healthovia.
• If Healthovia fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to Healthovia, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that Healthovia infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Your use of Healthovia must also comply with the App Store Terms of Service and its Usage Rules.
